ARTICLE 13: EXTERNAL GLITTER SERVICE (CUSTOMISATION OF A HELMET SUPPLIED BY THE CUSTOMER)
- Definition and nature of the service
The external glitter service is an exclusively cosmetic customisation service whereby Vísolde, at the request of the customer, applies decorative elements (including stones and/or lettering) to a helmet supplied by the customer of a brand other than Vísolde.
Within the scope of this service, Vísolde does not supply any helmet, safety product or replacement product, but performs solely aesthetic work. - Customer’s own helmet and own risk
The customer declares that the helmet submitted for the glitter service is the customer’s property and that the performance of the service takes place entirely at the customer’s own risk. - Duty of investigation and manufacturer’s warranty
The customer is solely responsible for investigating in advance whether:- cosmetic modification of the helmet is permitted by the manufacturer;
- the manufacturer’s warranty, certifications or approvals lapse in whole or in part as a result thereof.
- No liability in the event of loss of warranty or certification
Vísolde shall not be liable for:- the loss of (manufacturer’s) warranty;
- the loss of certifications or approvals;
- rejection of the helmet during inspections, competitions or insurance claims as a result of the customisation.
- Colour selection and aesthetic result
The customer determines the colour selection of the stones and any lettering, or authorises Vísolde to provide advice in this regard.
Vísolde shall perform the customisation to the best of its professional judgement and craftsmanship based on the choices specified by or on behalf of the customer.
Taste, personal preference or aesthetic assessment shall not constitute grounds for complaints, rectification, compensation or any other claim.
If the customer is dissatisfied with the final result, this shall be entirely at the customer’s own expense and risk. - No repair, replacement or new helmet
Within the scope of the external glitter service:- no new or replacement helmet shall be supplied;
- repair or reversal of the customisation is not possible;
- there shall be no right to refund, compensation or re-performance of the service on aesthetic grounds.
- Limitation of liability
Vísolde shall only be liable for direct damage that is the direct and demonstrable result of wilful intent or gross negligence on the part of Vísolde.
Any further liability, including consequential damage, indirect damage, non-material damage or damage resulting from use of the customised helmet, is excluded. - Acceptance upon ordering
By completing the order and checkout process, the customer declares:- to have taken note of this article;
- to agree to all conditions contained herein;
- to explicitly consent to the performance of the service at their own risk.
Article 14 – Detachment of the Helmet Shell
The Vísolde helmet consists of a safety module and an interchangeable, removable helmet shell. Due to the nature and construction of this system, the helmet shell may, under certain circumstances, become partially or completely detached from the safety module during use, including while riding.
The user acknowledges and accepts that detachment of the helmet shell may constitute an inherent characteristic and risk associated with the interchangeable system. The user is responsible for checking before each use that the helmet shell is correctly and fully attached and locked onto the safety module.
To the fullest extent permitted by applicable law, Vísolde B.V. shall not be liable for any loss or damage resulting from the helmet shell becoming partially or completely detached from the safety module, including direct or indirect loss, consequential loss, personal injury, or damage to property or animals.
This exclusion also applies to any loss, damage or injury resulting from a detached helmet shell causing a reaction by the user's horse or by any third party's horse, including where a horse becomes startled, bolts, rears or otherwise reacts unexpectedly, and to any resulting injury or damage suffered by the user, third parties, animals or property.
Nothing in this Article shall exclude or limit any liability that cannot lawfully be excluded or limited under mandatory Dutch or European law.
